Provision of data to NVM/brainbay

  • Providing a database that makes appraisals and other valuations possible and provides insight into developments in the housing market, commercial real estate market and agricultural real estate market. The data in this database will be kept indefinitely.

We take your privacy seriously

The NVM broker and NVM/brainbay take your privacy very seriously and see the rules surrounding data protection as logical standards of decency. The NVM broker processes your data carefully and in accordance with legal regulations. The NVM broker pays a lot of attention to adequate security so that your data is protected against unauthorized use, unauthorized access, modification and unlawful destruction. NVM/brainbay does not process names or other directly identifying data. If you would like to know what data NVM/brainbay processes, please contact the NVM broker who will then ensure that you are informed.

If you want to change or delete the data, please send a motivated letter or e-mail to the NVM broker. Your request will be fulfilled as soon as possible, unless the law requires the data to be retained or if there are (other) compelling reasons that oppose change or deletion.

How can you make a complaint?

If you have any questions or if you have a complaint about the NVM broker's use of data, please contact the NVM broker first. If you cannot reach an agreement with the NVM broker, you can contact the NVM complaints coordinator via: complaintscoordinator@nvm.nl . In that situation, the NVM Data Processing Officer may also consider the complaint. You also have the right to file a complaint with the Dutch Data Protection Authority.

How long does the NVM broker keep the data?

The NVM broker does not store the data longer than necessary. However, the NVM broker keeps a number of data for a long time:

  • The NVM broker keeps a number of data relating to the services for 20 years, because the NVM broker can be held liable for professional errors during this period.
  • The NVM broker retains the burden of proof that the NVM broker has carried out the mandatory test in the context of the Money Laundering and Terrorism Financing (Prevention) Act (Wwft) for 5 years.

If you want to sell/rent a home, business premises or agricultural real estate through an NVM estate agent, the following information will be made known to other NVM estate agents:

  • The address of the home, business premises or agricultural real estate, the description and characteristics of the object such as the asking price, year of construction, surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the property comes on the market, date the property is taken off the market. Conditional sale, sale date and transaction price.

This data is used by NVM brokers to provide services to their customers (seekers of a home, business premises or agricultural real estate).

This data is stored indefinitely in connection with the database with historical offers, see under C.

 B Current range of homes, commercial properties and agricultural real estate on (housing) websites, including Funda

If you want to sell/rent a home, business premises or agricultural real estate through an NVM estate agent, they can also make details known to Funda and other (housing) websites in consultation with you. This concerns the following data:

  • The address of the home, business premises or agricultural real estate, the description and characteristics of the object such as the asking price, year of construction, surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the object comes on the market, date of sale.

This information is used to bring your property to the attention of consumers, professional parties and/or third parties who search via (residential) websites.

This data may still be visible on these websites for a maximum of one year after the date of sale or the date on which a home, business premises or agricultural property is taken off the market.

C         Database with historical offerings

The following data is recorded in the NVM database for all homes, commercial properties and agricultural real estate that are offered for sale or rent through an NVM estate agent:

  • The address of the home, business premises or agricultural real estate, the description and characteristics of the object such as the asking price, year of construction, surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the property comes on the market, date the property is taken off the market. Conditional sale, transaction date and transaction price.
  • The zip code (1234AB) and house number of the buyer's previous (residential) address.

The aforementioned data will be kept indefinitely.

With the aforementioned data, brainbay enables analyzes of the real estate market on behalf of the NVM.

The NVM/brainbay also provides this data to selected third parties, namely:

  • NVM Appraisers, for carrying out appraisals and other valuations.
  • Validation institutes, after explicit instructions from an NVM appraiser, for checking appraisal reports.
  • Municipalities, for determining WOZ values.
  • The Ministry of Infrastructure and Water Management, for research into the housing market.
  • Universities, for research purposes.
  • NVM brokers in the context of services to their customers.
  • Non-NVM real estate agents, banks, project developers and housing associations, for research purposes (e.g. housing needs in a specific region).

These parties only have access to data for the stated purposes and where possible data is only provided at an aggregated level.

Internal audits and investigations
The NVM may view your data when it conducts an investigation among its members to determine whether the rules are being complied with and when the NVM conducts an audit of an NVM member. After inspection, this data will no longer be processed by the NVM.

View, change or delete data

If you would like to view, change or delete the data processed at NVM/brainbay, please contact the NVM via privacyhelpdesk@nvm.nl. The NVM assesses whether you are entitled to submit the request and subsequently whether your request will be granted.

We would like to send you a newsletter or a property notification, because you are a customer of ours or because you have registered for it. We therefore process your name and email address in order to send you information and news. We offer the option to unsubscribe under every newsletter. We keep your data for this purpose until you unsubscribe.
